Article 1 : Object

These T&Cs or General Terms and Conditions of Use legally govern the use of the online e-commerce solution 'blueseller'.

As the contract between BOURRAS CONSULTING, the owner of blueseller, and the User, access to the site must be preceded by the acceptance of these T&Cs. Access to this platform signifies acceptance of these T&Cs.


Article 2 : Legal Notices

The provision of blueseller services is ensured by BOURRAS CONSULTING, located at 61 rue de Lyon, Paris 12th, France.

The hosting provider of the blueseller.com site is OVH Cloud.


Article 3 : Site Access

The blueseller.com site allows subscription to the following services:

  • Creation of an online store;
  • Hosting subscription for a specified period;
  • Purchase and subscription to a domain name for a specified period;
  • Video conferencing assistance;

The site is accessible for free from anywhere by any user with Internet access. All necessary costs for accessing the services (computer equipment, Internet connection, etc.) are the responsibility of the user.

Access to blueseller services dedicated to subscribers is done using a username and password.

For maintenance or other reasons, access to the site may be interrupted or suspended by the publisher without prior notice or justification.


Article 4 : Data Collection

To subscribe to blueseller services, the collection of information at the time of registration on the site is necessary and mandatory. In accordance with Law No. 78-17 of January 6 relating to data processing, files, and freedoms, the collection and processing of personal information are carried out respecting privacy.

Following the Data Protection Act of January 6, 1978, Articles 39 and 40, the User has the right to access, rectify, delete, and oppose their personal data. This right can be exercised through:

  • Their client space;


Article 5 : Intellectual Property

Trademarks, logos, and content on the blueseller.com site (graphic illustrations, texts, etc.) are protected by the Intellectual Property Code and copyright.

The purchase of the domain name is made by blueseller in its name. The domain name can be returned to the client upon simple request via the 'Contact Us' section.

Reproduction and copying of content by the User require prior authorization from the site. In this case, any use for commercial or advertising purposes is prohibited.


Article 6 : Liability

The text and image content of online stores hosted on blueseller are the responsibility of the User. blueseller cannot be held responsible in case of violation of applicable law. Nevertheless, blueseller reserves the right to suspend or close any offending store without compensation or prior notice.

The site declines all responsibility for any viruses that may infect the User's computer equipment following the use or access to this site.

The site cannot be held responsible in case of force majeure or unforeseeable and insurmountable circumstances caused by a third party.

The total guarantee of data security and confidentiality is not assured by the site. However, the site undertakes to implement all required methods to do so to the best of its ability.


Article 7 : Hyperlinks

The site may contain hyperlinks. By clicking on these, the User will leave the platform. The platform has no control and cannot be held responsible for the content of the web pages associated with these links.


Article 8 : Cookie

During visits to the site, the automatic installation of a cookie on the User's browser software may occur.

Cookies are small files temporarily placed on the User's computer hard drive. These cookies are necessary to ensure accessibility and navigation on the site. These files do not contain personal information and cannot be used to identify a person.

By browsing the site, the User accepts cookies. Their deactivation can be done via the settings of the browser software.


Article 9 : Publication by the User

The blueseller site allows its Users, subscribed to an online store offer, to sell products and services that comply with the publication conditions, worldwide, in the currency of their choice from a selection available.

Every online store on blueseller must be linked to a business entity.

Every online store on blueseller has its own General Terms and Conditions of Use.

Every online store on blueseller undertakes to collect taxes and pay them to the competent authorities.

Products and services offered for sale must comply with applicable laws in the country where the associated business entity is located.

Prohibited products and services include (non-exhaustive list): alcohol, meat, drugs, medications, medical care, lotteries, financial services, counterfeit products, pornography, and prostitution.


Article 10 : Contract Duration

This contract is valid for an indefinite period. The start of using the site's services marks the application of the contract to the User.

At the end of the subscription, the online store is no longer accessible.

Access to the 'My Account' section allows access to the history of orders, contacts, and clients.


Article 11 : Applicable Law and Jurisdiction

This contract is subject to French law. The failure to resolve disputes amicably between the parties involves recourse to the competent French courts to settle the dispute.
